Eligibility

• Entries are only accepted on instagram.
• Entrants must include #HerbalApeGreens or #HerbalApeContest with their instagram post.
• Entries must be the original work of the entrant and may not infringe third-party rights.

Entry Period

• Starts: April XX, 2025.
• Ends: June 30, 2025, at 11:59 PM PT.
• Late entries will not be considered.

Selection Process

• The top 5 posts with the most likes by the deadline will be named finalists.
• From these, Herbal Ape™ will select 3 winners based solely on:
• Creativity (40%)
• Originality (40%)
• Brand alignment (20%)
• Judging is at Herbal Ape’s discretion; decisions are final.

Prizes

• 1st Place (1 winner): 12 jars of Herbal Ape™ Greens + Electrolytes, delivered directly by us (quantity and fulfillment at the sole discretion of Herbal Ape™).
• 2nd & 3rd Place (2 winners): One jar of Herbal Ape™ Greens + Electrolytes, delivered directly by us (quantity and fulfillment at the sole discretion of Herbal Ape™).
• There are a total of Three Winners for the purpose of this giveaway. One first-place winner (12 jars), one second-place winner (1 jar), one third-place winner (1 jar).
• The Approximate Retail Value (ARV) of the First place prize is $552 (based on 12 units at $46 each).
• The Approximate Retail Value (ARV) of the Second and Third place prizes is $46 each (based on one unit at $46).
• Sales tax and shipping are not charged to winners.
• Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash. If inventory is unavailable, fulfillment may be delayed until restocked.
• Sponsor reserves the right to substitute a prize of equal or greater value if necessary.

Winner Notification

• Winners will be contacted via Instagram DM and/or email by July 7, 2025.
• Winners must respond within 7 days to claim their prize, or an alternate winner may be selected.

Rights Granted

• By entering, participants grant Herbal Ape™ a worldwide, royalty-free, perpetual license to use, reproduce, and share your submitted content (photos/videos) for marketing, promotional, or advertising purposes, with credit provided where feasible.
• By entering, participants grant Herbal Ape the right to use their name, social media handle, likeness, and content for promotional purposes without additional compensation, where permitted by law.

• This giveaway is not sponsored, endorsed, or administered by, or associated with Instagram or TikTok.
• By participating, entrants release Instagram, TikTok, and Herbal Ape™ from any and all liability related to this promotion.
• Herbal Ape™ may disqualify entries that:
• Do not meet eligibility or entry requirements.
• Contain inappropriate, offensive, or unlawful content.
• Violate platform community standards.
• Herbal Ape™ reserves the right to modify, suspend, or cancel the giveaway if circumstances (e.g., fraud, technical issues) compromise its integrity.
• Sponsor reserves the right to disqualify any entry that appears to involve fraudulent activity, including but not limited to the use of fake accounts, bots, paid likes, or vote manipulation. The integrity of the contest is at the sole discretion of the Sponsor.
• Any winner of a prize valued at $600 or more may be required to complete a W-9 and will receive a 1099 form for tax purposes. All taxes are the responsibility of the winner.
• Winners may be required to complete and return an affidavit of eligibility, a liability/publicity release, and any required tax documentation as a condition of receiving the prize. Failure to comply may result in forfeiture of the prize.

Governing Law

• This giveaway is governed by the laws of the State of Nevada, U.S. Disputes will be resolved in Reno, NV courts.
